Art. 13 and 14 GDPR). With this statement (hereinafter: "Privacy Notice"), we inform you about how we process your personal data.

Our privacy notice has a modular structure. It consists of a general section covering any processing of personal data and processing situations that apply whenever you access our website and whenever a business relationship exists (A. General), and a specific section, the content of which relates only to the processing situation indicated there, naming the respective offer or product, in particular the visit to websites detailed here (B. General

(1) Definitions

Based on Art. 4 GDPR, this privacy notice is founded on the following definitions:

"Personal data" (Art. 4(1) GDPR) means any information relating to an identified or identifiable natural person ("data subject"). An identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person. Identifiability may also result from linking such information with other supplementary knowledge. The origin, form, or embodiment of the information is irrelevant (photos, video, or audio recordings may also contain personal data).

"Processing" (Art. 4(2) GDPR) means any operation involving personal data, whether or not carried out using automated (i.e., technology-assisted) means. This includes, in particular, collection (i.e., acquisition), recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction of personal data, as well as any change to the purpose for which the data was originally processed.

"Controller" (Art. 4(7) GDPR) means the natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.

"Third party" (Art. 4(10) GDPR) means any natural or legal person, public authority, agency, or other body other than the data subject, the controller, the processor, and persons who, under the direct authority of the controller or processor, are authorized to process personal data; this also includes other legal entities belonging to the same group of companies.

"Processor" (Art. 4(8) GDPR) means a natural or legal person, public authority, agency, or other body that processes personal data on behalf of the controller, in particular in accordance with its instructions (e.g., an IT service provider). In the legal sense of data protection law, a processor is specifically not a third party.

"Consent" (Art. 4(11) GDPR) of the data subject means any freely given, specific, informed, and unambiguous indication of the data subject's wishes in the form of a statement or a clear affirmative action, signifying agreement to the processing of personal data relating to them.

(2) Name and Address of the Data Controller

The body responsible for processing your personal data within the meaning of Art. 4(7) GDPR is:

on:NetworkAgency UG (haftungsbeschränkt)
Holstenhofweg 54
22043 Hamburg
Germany

Phone: +49 (40) 7929 97
Email: hello@onnetwork.agency

For further details about our company, please refer to the legal notice on our website [https://onnetwork.agency/en/legal-notice/].

(3) Legal Basis for Data Processing

In principle, any processing of personal data is prohibited by law and only permitted if the data processing falls under one of the following legal grounds:

Art. 6(1)(1)(a) GDPR ("consent"): If the data subject has freely, in an informed manner, and unambiguously indicated their agreement, by way of a statement or other clear affirmative action, to the processing of their personal data for one or more specific purposes;

Art. 6(1)(1)(b) GDPR: If the processing is necessary for the performance of a contract to which the data subject is party, or in order to take steps at the request of the data subject prior to entering into a contract;

Art. 6(1)(1)(c) GDPR: If the processing is necessary for compliance with a legal obligation to which the controller is subject (e.g., a statutory retention obligation);

Art. 6(1)(1)(d) GDPR: If the processing is necessary to protect the vital interests of the data subject or of another natural person;

Art. 6(1)(1)(e) GDPR: If the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller; or

Art. 6(1)(1)(f) GDPR ("legitimate interests"): If the processing is necessary to safeguard the legitimate interests (in particular legal or economic interests) of the controller or a third party, unless such interests are overridden by the interests or fundamental rights of the data subject (particularly if the data subject is a minor).

The storage of information on the end user's device, or access to information already stored there, is only permitted if covered by one of the following legal grounds:

Section 25(1) TTDSG: If the end user has consented on the basis of clear and comprehensive information.
